Maryland Wage and Overtime Law

The federal Fair Labor Standards Act (FLSA) sets the “floor” minimum wage for eligible workers in the U.S. But, many states and some local governments set their own minimum wage. Workers are entitled to be paid the highest minimum wage that applies where they work, whether it is set by federal, state, or local law.

The minimum wage in Maryland is $8.25 an hour. Because this is higher than the federal minimum wage of $7.25, employees in Maryland must be paid at least $8.25 an hour.

Montgomery County and Prince George's County have both passed laws setting a higher minimum wage. Employess in these counties must be paid at least the higher local minimum wage of $9.55.
