ChatGPT 4.0 Prompts on Probate Procedures

We’ve assembled a starter set of prompts that will yield useful results for your location.

This article assumes you have read the articles on this site about the possible shortcomings of ChatGPT and how to check the responses that ChatGPT gives you.

It also assumes that you are paying the $20 monthly required to use ChatGPT 4.0. We do not recommend using the free version 3.5 for legal research because it is too unreliable. Version 4.0 is different and is still not perfect but 10X better.

In our experiments, these prompts yielded useful, correct responses in the vast majority of cases. And that’s worth a lot. And with some checking, you can improve those odds and learn if the law has been updated. Using ChatGPT, and checking its results with other online research tools, can make it a very reliable way to quickly learn about state and local inheritance laws and procedures.

Test Prompt #1 (leins):

What is the process for perfecting a lien in Chatham County, Georgia? Describe the process step by step and provide citations for each step. Are the procedures for a perfecting judgment lien different than those for perfecting a mechanics lien? When does it matter that whether a lien is perfected or not in Georgia?

ChatGPT4.0 Answer:

Perfecting a lien means filing it properly so that it's enforceable against the debtor and third parties. The process can vary depending on the type of lien.

Here's a general guideline on how to perfect a mechanic's lien in Georgia as of my knowledge cutoff in September 2021. For Chatham County, you would file these documents with the Clerk of Superior Court in Chatham County.

  1. Serve Notice: For private projects, Georgia law requires that a contractor or subcontractor must provide a Notice to Owner and Notice to Contractor within 30 days of beginning the work or delivering the materials. (O.C.G.A. § 44-14-361.5(b)).

  2. File Claim of Lien: The next step is to file a claim of lien. This must be done within 90 days of the last day you provided labor or materials to the project. (O.C.G.A. § 44-14-361.1(a)(2)).

  3. Serve a Copy of the Lien: Within two business days of filing the lien, you must send a copy of the lien claim to the property owner and the contractor. (O.C.G.A. § 44-14-361.1(a)(2)).

  4. Action to Enforce the Lien: If payment isn't received, you must initiate a legal action to enforce the lien within 365 days of the date you filed the lien. (O.C.G.A. § 44-14-361.1(a)(3)).

Perfecting a judgment lien in Georgia follows a slightly different process.

  1. Obtain a Judgment: First, you must win a lawsuit against the debtor to obtain a judgment.

  2. Filing of Writ: After receiving the judgment, you need to file a Writ of Fieri Facias, also known as a FiFa, with the clerk of the court. The FiFa is the legal document allowing you to place a lien on the property. (O.C.G.A. § 9-12-86).

  3. Record the FiFa: The FiFa must then be recorded in the county where the property is located to perfect the judgment lien.

In Georgia, whether a lien is perfected or not is crucial. A perfected lien has priority over many other types of liens and is protected in the event of bankruptcy or sale of the property. An unperfected lien is generally not enforceable against third-party purchasers or in bankruptcy. (O.C.G.A. § 44-14-361.1(a)(2)).

Please consult with a legal professional to ensure you have the most accurate and up-to-date information about your specific situation, as this advice is based on laws and regulations up until September 2021, and the legal landscape may have changed.
